These Terms & Conditions (“Terms”) govern your access to and use of barstoolexpress.com.au (“Site”) and purchases from Barstool Express (“we”, “us”, “our”). By using the Site, you agree to these Terms.

2. Eligibility & Your Account

  • You must be at least 18 years old or have legal guardian consent.
  • Provide accurate, current information and keep your details up to date.
  • You are responsible for maintaining the confidentiality of your account and for all activity under it.

3. Orders & Acceptance

  • Your order is an offer to buy. We may accept or reject an order at our discretion (e.g., stock availability, payment issues, suspected fraud).
  • Order confirmation emails acknowledge receipt but do not constitute acceptance until we dispatch the goods.
  • If we cannot fulfil your order, we’ll cancel and issue a refund for any amounts paid.

4. Pricing, Taxes & Payment

  • All prices are listed in Australian dollars (AUD). We are not currently registered for GST; no GST is charged.
  • We may change prices at any time before acceptance of your order.
  • We accept the payment methods shown at checkout. Payments are processed securely by third-party providers.

5. Shipping & Delivery

  • We offer free delivery Australia-wide (some remote areas excluded). See our Shipping Policy for details.
  • Delivery timeframes are estimates only; delays can occur due to courier capacity, weather, or public holidays.
  • Risk in the goods passes on delivery to the address you provide.

6. Cancellations, Returns & Exchanges

  • Cancellations: You may cancel your order before dispatch by contacting us promptly. Once dispatched, our returns process applies.
  • Change of Mind: Returns accepted within 30 days of delivery, subject to eligibility; customer arranges and pays return courier/freight unless required otherwise by law.
  • Damaged/Incorrect Items: Contact us within 48 hours with photos; we will assess and arrange a remedy per the ACL.

7. Product Information & Availability

  • We aim for accurate descriptions, images, dimensions, and colours; minor variations may occur.
  • Stock levels can change quickly; availability is not guaranteed until dispatch.

8. Australian Consumer Law (ACL)

Nothing in these Terms excludes, restricts, or modifies any consumer guarantees, rights, or remedies under the ACL that cannot be excluded. Where legally permitted, our liability is limited to the repair or replacement of the goods or the cost of doing so.

9. Warranties & Liability

  • Except as required by the ACL or expressly stated by us, the Site and products are provided “as is”.
  • To the maximum extent permitted by law, we are not liable for indirect or consequential loss, loss of opportunity, or loss arising from delays outside our reasonable control.

10. Intellectual Property

All content on the Site (including logos, images, text, and graphics) is our property or licensed to us and is protected by intellectual property laws. You must not reproduce, distribute, or create derivative works without prior written consent.

11. Acceptable Use

  • Do not misuse the Site (e.g., introduce malware, attempt unauthorised access, scrape content, or engage in fraudulent activity).
  • Do not use the Site for unlawful purposes or to infringe the rights of others.
